Products
We sell handcrafted rings and jewellery made from natural and specialist materials, including meteorite, Damascus steel, reclaimed wood, dinosaur bone, titanium, tungsten, zirconium and carbon fibre.
Because our products are handcrafted and use natural materials, variation in grain, pattern, colour, texture and figure is inherent and expected. No two pieces are identical. Such natural variation is a characteristic of the product and is not a fault or defect. We make reasonable efforts to represent our products accurately, but colours and finishes may appear differently on different screens.
Many of our products are made to order and personalised to your specification (for example, engraving, custom sizing or bespoke configurations). This affects your right to cancel — see "Your right to cancel" below.
Orders and contract formation
Your order is an offer to buy from us. We may accept or decline it. A binding contract is formed only when we send you an email confirming that your order has been accepted or dispatched. If we are unable to accept your order, we will tell you and will not charge you, or will refund any payment taken.
We reserve the right to refuse or cancel an order for reasons including, but not limited to: unavailability of a product, an error in the price or description of a product, an error in your order, or where we suspect fraud or an unauthorised or unlawful transaction.
Pricing, taxes and duties
Prices are shown on the Service and may change at any time, though changes will not affect orders we have already accepted. Where required, prices include UK VAT.
For international orders, the price you pay and the treatment of taxes, customs duties and import charges depend on the destination and the shipping option selected at checkout. Where charges are not collected by us at checkout, you are responsible for any duties, taxes or fees levied by the destination country. We will make the applicable charges clear before you complete your order wherever we are able to.
Despite our best efforts, products may occasionally be mispriced. If we discover an error in the price of a product you have ordered, we will contact you to confirm whether you wish to proceed at the correct price, or to cancel the order.
Payment
Payment is processed by third-party payment providers. By submitting your payment details, you confirm that you are authorised to use the payment method and that the information you provide is accurate. We share information with these providers only as necessary to process your payment, in line with our Privacy Notice.
Delivery and risk
We will deliver to the address you provide. Delivery timescales given on the Service are estimates. Responsibility for the goods passes to you when they are delivered to the address you provided.
Your right to cancel (consumers)
If you are a consumer, you have a statutory right to cancel your order and return your item within 14 days of receiving it, without giving a reason. This right exists under UK law (the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013) and equivalent consumer protection law in the EU and the other markets we serve.
EU customers can exercise this right directly using the withdrawal function on our website — you do not need an account and you do not need to contact us first. We will confirm your request by email.
Full details of how to cancel, how to return your item, refund timescales and the costs involved are set out in our Refunds & Returns policy, which forms part of these Terms.
Items excluded from the right to cancel. Because many of our products are made to order, certain items are exempt from the statutory right to cancel — including rings engraved to your specification, made to a custom or non-standard size, or otherwise personalised or bespoke. Where this applies, it is clearly indicated on the product page before you order. This exclusion does not affect your rights where an item is faulty, not as described or not fit for purpose.
Faulty goods and your statutory rights
Nothing in these Terms affects your statutory rights as a consumer. These rights cannot be excluded or limited and they apply in addition to any voluntary policy we offer.
- In the United Kingdom, under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose and as described.
- In the European Union, you benefit from a legal guarantee of conformity for goods that are faulty or not as described.
- In Australia, our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
- In New Zealand, the Consumer Guarantees Act applies to goods supplied to consumers.
If an item is faulty, damaged on arrival or not as described, please contact us promptly and we will put it right in line with your statutory rights. Natural variation in handcrafted and natural-material products (see "Products" above) is not a fault.
Intellectual property
The Service and its content (excluding content you provide), including its design, text, graphics, logos, images, product designs and software, are and will remain the property of Forge & Lumber or its licensors, and are protected by copyright, trade mark and other laws of the United Kingdom and other countries. Our trade marks and trade dress may not be used in connection with any product or service without our prior written consent.
You may not copy, reproduce, distribute, modify, republish or otherwise use any content from the Service for commercial purposes or personal gain without our prior written permission.
Content you provide
If the Service allows you to submit content (for example, reviews, images or other material), you remain responsible for that content, including its legality and accuracy. By submitting content, you confirm that it is yours or that you have the right to use it, and that it does not infringe the rights of any third party. You grant us a non-exclusive, royalty-free licence to use, display, reproduce and distribute that content in connection with the Service. We may, but are not obliged to, monitor, edit or remove content, and we may remove content that we reasonably consider unlawful or inappropriate.
Reporting intellectual property infringement
If you believe that content on the Service infringes your copyright or other intellectual property rights, please contact us at info@forgeandlumber.com with the subject line "IP Infringement", including a description of the work concerned, the location of the allegedly infringing material, your contact details, and a statement that you have a good-faith belief the use is not authorised. We will review and respond to legitimate notices.
Links to other websites
The Service may contain links to third-party websites or services that we do not own or control. We are not responsible for the content, policies or practices of any third-party site or service, and we recommend you review their terms and privacy policies. We are not liable for any loss or damage arising from your use of, or reliance on, any third-party site or service.
Acceptable use
You agree not to use the Service in any way that is unlawful, fraudulent or harmful, to interfere with its operation or security, or to attempt to gain unauthorised access to any part of the Service or its systems.
Disclaimers
We provide the Service with reasonable care and skill. However, we do not guarantee that the Service will be uninterrupted, error-free or secure, or that defects will be corrected. To the extent permitted by law, the Service and its content are provided "as available". Nothing in this section limits or affects your statutory rights as a consumer or any liability that cannot be excluded by law.
Limitation of liability
Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; any breach of your statutory rights as a consumer; or any other liability that cannot be excluded or limited under applicable law.
Subject to the above, we are not liable for losses that were not foreseeable, for losses not caused by our breach, or for business losses (we supply our products to consumers for private use). Where we are liable to you, our liability is limited to the extent permitted by law.
Events outside our control
We are not responsible for any failure or delay in performing our obligations where this is caused by events outside our reasonable control. If such an event occurs, we will contact you as soon as reasonably possible and take steps to minimise any delay.
Changes to these Terms
We may modify these Terms from time to time. If a change is material, we will give reasonable notice before it takes effect. By continuing to use the Service after changes take effect, you accept the revised Terms. Changes will not apply retrospectively to orders we have already accepted.
Governing law and jurisdiction
These Terms are governed by the laws of England & Wales. If you are a consumer, nothing in this clause deprives you of the protection afforded by the mandatory consumer-protection laws of the country in which you live, and you may be able to bring proceedings in the courts of your home country. Otherwise, the courts of England & Wales will have jurisdiction.
General
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect. Our failure to enforce any right or provision is not a waiver of that right or provision. These Terms, together with our Refunds & Returns policy and Privacy Notice, form the entire agreement between you and us regarding the Service.
